Objects and scope
Our sale is subject to general terms and conditions that take precedence over any other provisions of the buyer. The general sales conditions arrange the relationship between La Fourmi and any other professional buyer, regardless of whether the order was placed directly or online. Each order implies unconditional compliance with these general sale conditions.
La Fourmi does not sell to private individuals. Moreover, an order is only possible from a minimum amount of 100 euros.
From the moment the customer registers his order, he is deemed to have accepted the prices and quantities.
The information, photographs and images of the catalogue and the website are only indicative and do not bind La Fourmi.
Unless otherwise stated, the prices are always expressed in euros, excluding taxes and shipping costs. La Fourmi reserves the right to change the prices at any time, unless it’s a specific contractual agreement for an agreed period between La Fourmi and the customer. If the order does not meet the conditions for free shipment, shipping costs will be communicated to the customer as from the moment the order is ready.
The amount of VAT is indicated during the completion of the order. If the VAT rate would change, this change can be reflected in the price of the items on the basis of a change in the applicable rates and without the customer being informed in advance.
Any international order placed and delivered via our website (except Belgium) may be subject to taxes and custom duties that are imposed when the package reaches its destination. These custom duties and all taxes related to the delivery are the responsibility of the customer.
La Fourmi is not obliged to check and inform its customers about applicable custom duties and taxes. By ordering, customers are considered the official importer and must comply with all laws and regulations of the country where the goods are received.
Unless otherwise stated, the products are pro forma payable when placing the order by credit card, bank transfer or check. Any amount paid by the customer for the delivery of a product constitutes a down payment on the sales price that is definitive due by the customer.
Sanctions of an amount equal to the base bank rate plus 3 points automatically apply to amounts that have not been paid after a period of 10 days following the invoice date or after notification of the refusal of bank payment. The delivery of a new order can be suspended in case of late payment of a previous order.
A credit issued by La Fourmi can be used to pay later invoices up to a maximum of one year from the date of issue. Under no circumstances may the customer deduct an amount from the invoice without first receiving a credit note from La Fourmi.
Delivery and transport
The delivery times communicated by La Fourmi are indicative. No damage or interest can be claimed from La Fourmi in case of non-compliance with the indication for the delivery time that was communicated with the order.
The goods travel at the customer’s risk, regardless of the method of shipment. The customer must check the goods upon receipt. If the customer finds any damage or missing products, this is his responsibility to report to the carrier. This will confirm within three days (with exception of public holidays) by registered letter and with a copy to La Fourmi.
The delivery is deemed to have been performed as soon as the buyer receives the product. Any claim regarding quantity, nature, color… must be sent by registered mail with acknowledgement of receipt within a period of 8 days, from the receipt of these goods and must contain an accurate description. The customer cannot return products without written permission of La Fourmi.
Transfer of ownership and risks
The seller retains full ownership of the products sold until full payment (price, principal, costs and taxes) is received. The transfer of risks relating to the product takes place when the ordered product is handed over to the carrier. It is the responsibility of the customer to take out insurances at this own expense to cover any risk, including loss and degradation.
Guarantees and responsibility
The products sold are covered by the manufacturer’s warranty. The warranty does not apply to products that are modified or repaired by the customer, or any other person not expressly authorized by the seller, as well as all products covered by a specific support and maintenance contract.
Any return of a product under the above warranty must be approved in advance by La Fourmi. For these purposes, the customer will contact La Fourmi’s customer service by formulating his request by mail. When the product proves to be defective, La Fourmi sends a return number. The defective product must be returned in the original packaging and accompanied by the received return number. All costs and risks associated with the return of the product are the responsibility of the customer.
The seller can never be held liable for indirect damage. In case of direct damage, the liability of the seller is limited to the value of the product.
Attribution of juridiction
The general conditions of sale are governed by Belgian law. For all disputes concerning the contract between the customer and the seller, the Commercial Court in Brussels is the exclusive jurisdiction. Informatique et Liberés: In application of the Data Protection Act of 8 December 1992, the customer has the right to access the rectification of his data stared by the seller.
All information on our website, in our catalogue and in our publications is the property of La Fourmi or has the rights to use and publish it. It is forbidden for internet users to republish, reproduce or download content, in whole or in part, regardless of images, descriptions, prices or technical explanations, with the exception of: documents specifically provided for download on our website, such as the catalog from La Fourmi.
